General terms and conditions of business

This agreement is valid unless there are further agreements between the customer (you) who is at least 18 years old and the manufacturer (Zauber Lingerie). For different agreements, we ask you to contact us before placing your order. As soon as you have placed the order, Zauber Lingerie will send you an order confirmation to the email address provided in your customer account. It is therefore your responsibility to provide a working email address and to check the order confirmation carefully. If you discover any discrepancies here, please contact us immediately so that we can make any changes if necessary, as the order confirmation is binding. Once a garment designed by you has been cut (i.e. production has started), no further changes can be made.  As soon as the goods have been received by the customer, the contract is deemed to have been fulfilled.

  1. conclusion of the contract

1.1 The Zauber Lingerie product range is non-binding; as a customer, you submit a binding purchase offer by submitting your order in the last step of the ordering process.

1.2 After placing your order, you will receive an automatically generated email from us confirming receipt of the order and containing its details (order confirmation). This order confirmation does not constitute acceptance of the contract. A contract is only concluded when a separate order confirmation is sent or when the goods are delivered. In the order confirmation, we will ask you to pay within 7 working days if you have agreed to pay in advance by bank transfer.

1.3 Processing of your order will begin as soon as the total amount of your order has been credited to our account. If you pay by credit card, PayPal or Amazon Payments, the order value (including possible shipping costs) will be debited directly.

1.4 If the total amount of your order has not been credited to our account within 7 days of sending the order confirmation, despite it being due, we may withdraw from the contract, with the result that your order is no longer valid and we are not obliged to deliver. The order is then completed for both parties without any further consequences.

  1. Delivery

2.1 During the order process, you will be informed of the estimated delivery time of your order. This estimate is based on the current production queue and the time it takes for an order to be shipped from our tailor shop to your address. The delivery time cannot be guaranteed as this is only an estimate. We constantly monitor our production, air freight and final delivery. We always work to deliver your order as quickly as possible. Zauber Lingerie cannot be held responsible for any loss, inconvenience, cost or other damage caused by late deliveries.

2.2 We calculate  €35  Handling costs for packages that are not accepted/not picked up/returned. Please always collect your order from your local post office or packing station within 14 days of receipt of delivery to avoid this fee.

  1. cancellation policy

You have the right to withdraw from the contract without giving any reason within 14 days from the day on which you receive the goods.If you decide to withdraw from the sale, you are obliged to return the delivered goods at your own expense. Goods made to individual customer specifications such as bras, corsets, panties, garter belts are excluded from the right of return (even if they were ordered in standard sizes).

  1. tolerances

Zauber Lingerie's tailor-made products are always made according to the information you have given us. Please note that adjustments to the measurements may be necessary. Since our tailor-made garments are handmade, tolerances of +/- 2.0 cm are possible and do not constitute a defect. Since you give us your body measurements, usual, so-called allowances are taken into account. We cannot guarantee that products ordered in standard sizes will fit perfectly. For this reason, we recommend that you use personal measurements. The number of hooks on the bra or corset may vary depending on the size of the product. The tailor chooses the best solution for each individual garment. It may happen that slight chalk marks can still be seen on the garments when they are delivered, but these will easily disappear after the first wash. We strive to constantly improve the quality and design of our products and our website. For this reason, it may happen that two tailor-made products ordered at different times show slight differences from each other. As our products may come from different fabric deliveries, the fabrics may vary slightly in shade. This is due to normal variations in the dyeing process. Should any problems other than those described occur, we will endeavour to resolve them as quickly as possible as we want to provide the best service to our customers.

  1. conformity

The garment shown is a visualization. The final product may vary slightly in construction and color. Color reproduction varies from screen to screen and therefore the images are not an exact color reference, but are intended to be a guide only.

  1. warranty

The warranty is provided in accordance with statutory provisions. For all defects that occur during the statutory warranty period of two years from delivery, you have the right to subsequent performance (at your discretion: remedy of the defect or new delivery) and - if the statutory requirements are met - the right to a reduction or withdrawal as well as compensation for damages. If the dimensions or design of the tailor-made product do not correspond to the specified dimensions for reasons other than those listed above, we will offer you a new, equivalent tailor-made product or you will receive a refund. Zauber Lingerie will offset the costs of returns in the form of credit on your customer account if the items are sent in the original packaging using the cheapest possible shipping method. As our customer, you are responsible for the specified dimensions.

  1. vouchers

7.1 Promotional vouchers are only valid during the specified promotional period, are non-transferable, cannot be combined and cannot be redeemed for cash.Individual products may be excluded from voucher promotions. A promotional voucher will not be refunded if the ordered goods are returned in whole or in part.

7.2 Gift vouchers cannot be used to purchase additional gift vouchers and cannot be redeemed for cash. A gift voucher is transferable; our general terms and conditions and data protection provisions apply to the redemption of the voucher.

7.3 The order value must be at least equal to the amount of the voucher. Any remaining balance cannot be refunded.

7.4 Only one promotional voucher or gift voucher can be redeemed during an order process.

7.5 In the event of fraud, attempted deception or suspicion of other illegal activities in connection with the purchase or redemption of a voucher, there is no entitlement to activation, crediting or payment of the voucher.

In order to avoid unnecessary costs and to continue to be able to offer attractive prices for our customers, we do not offer telephone customer service. All inquiries are processed by email and we try to answer them within 24 hours on working days. To receive an answer as quickly as possible, please fill out the form on our customer service page.

  1. Data protection, change of address and copyright

9.1 The customer gives his consent for the personal data included in the purchase contract to be stored and processed by us using automated means in order to fulfil this contract. Zauber Lingerie is responsible for the personal information provided to us by our customers. This is only used to manage customer relationships. Neither personal information nor email addresses are passed on to third parties.

9.2 The customer is obliged to inform us of any changes to his or her residential or business address as long as the contractual transaction has not been fully fulfilled by both parties. If this notification is omitted, declarations shall be deemed to have been received even if they are sent to the last address provided.

9.3 The entire content of the website, including texts, graphics, photos, images, moving images, sounds, illustrations, software, plans, sketches or other technical documents, as well as samples, catalogs, brochures, images and the like, are our intellectual property. This content is protected by copyright and other rights. Its use is only permitted with our express consent. All trademarks used on the website are - unless otherwise stated - our trademarks. These may not be used without our prior written consent.

  1. Applicable Law Jurisdiction, Severability Clause

10.1 All legal relationships or other legal relationships with us are governed exclusively by the law of the Federal Republic of Germany. The application of the UN Convention on Contracts for the International Sale of Goods is excluded.

10.2 The place of performance and jurisdiction is – as far as legally permissible – Hamburg. However, Zauber Lingerie is also entitled to sue at the customer's registered office.

10.3 Should any of these terms and conditions be or become invalid in whole or in part, this shall not affect the validity of the other provisions and the contracting parties undertake to replace the invalid provision with a provision that comes as close as possible to the original intention of the contracting parties.

10.4 For the out-of-court settlement of disputes between you and Zauber Lingerie, you as a customer generally have the option of contacting the European Union’s online dispute resolution body using the following link: http://ec.europa.eu/consumers/odr/

  1. Force majeure

In the event of force majeure, the agreement may either be considered legally annulled, without any obligation to pay compensation for Zauber Lingerie or the customer, or the delivery times may be extended in accordance with the nature of the force majeure. Zauber Lingerie considers as force majeure: war, mobilization, acts of terrorism, work stoppages, transport disruptions, restrictive measures in trade policy, strikes, non-delivery or overdue deliveries by Zauber Lingerie's suppliers, natural disasters and, in general, all circumstances, events, reasons and consequences beyond our control.
