General Terms and Conditions

 

This agreement is valid as long as there are no further agreements between the customer (you) with a minimum age of 18 years and the manufacturer (Zauber Lingerie). If you have any other arrangements, we would like to ask you to contact us before placing your order. As soon as you have placed your order, Zauber Lingerie will send you an order confirmation to the email address specified in your customer account. It is therefore your responsibility to provide a working email address and to check the order confirmation carefully. If you discover any discrepancies, please contact us immediately so that we can correct them if necessary. You can make changes because the order confirmation is binding. Once a garment you have designed has been cut (i.e.H Once production has started), no more changes can be made.As soon as the goods have been received by the customer, the contract is deemed to have been fulfilled.

 

  1. Conclusion of contract

1.1 The Zauber Lingerie product range is non-binding; as a customer, you are making a binding purchase offer by submitting your order in the last step of the ordering process.

1.2 After placing your order, you will receive an automatically generated email from us confirming receipt of the order and providing its details (order confirmation). This order confirmation does not constitute acceptance of the contract. A contract is only concluded by sending a separate order confirmation or by delivering the goods. In the order confirmation, if you agree to pay in advance by bank transfer, we will ask you to pay within 7 working days.

1.3 Processing of your order begins as soon as the total amount of your order has been fully credited to our account. When paying by credit card, PayPal or Amazon Payments, the order value (incl. possible shipping costs) will be debited directly.

1.4 If the total amount of your order has not been credited to our account within 7 days of sending the order confirmation despite the due date, we can withdraw from the contract with the result that your order is no longer valid and we are not obliged to deliver. The order is then completed for both parties without any further consequences.

 

  1. Delivery

2.1 During the ordering process you will be informed about the expected delivery time of your order. This estimate is based on the current production queue and the time it takes for an order to be shipped from our tailor shop to your address. Delivery time cannot be guaranteed as this is only an estimate. We constantly monitor our production, air freight and final delivery. We are always working to deliver your order as quickly as possible. Zauber Lingerie cannot be held responsible for any loss, inconvenience, costs or other damage caused by late deliveries.

2.2 We charge €35 handling costs for parcels that are not accepted/uncollected/returned. Please always collect your order from your local post office or packing station within 14 days of delivery to avoid this fee.

 

  1. Cancellation policy

You have the right to withdraw from the contract without giving reasons before a period of 14 days from the day on which you receive the goods. If you decide to withdraw from the sale, you are obliged to return the delivered goods at your own expense. Goods manufactured according to individual customer requirements such as bras, corsages, underpants and suspender belts are excluded from the right of return (even if they were ordered as a standard size).

  1. Tolerances

Zauber Lingerie's tailor-made products are always made according to the information you have given us. Please note that it may happen that adjustments to the dimensions are necessary. Since our tailored garments are handmade, tolerances of +/- 2.0 cm are possible and do not constitute a defect. Since you provide us with your body measurements, usual so-called measurements will be taken into account. We cannot guarantee that products ordered in standard sizes will provide a perfect fit. For this reason, we recommend that you use personal measurements. The number of hooks on the bra or corsage can vary depending on the size of the product. The tailor chooses the best solution for each individual garment. It may happen that slight traces of chalk may still be visible on the garments upon delivery, but these will disappear without any problem after the first wash. We strive to continually improve the quality and design of our products and our website. For this reason, two bespoke products ordered at different times may have slight differences from each other. Since our products may come from different fabric supplies, the fabrics may vary slightly in shade. This is due to normal fluctuations in the dyeing process. If problems other than those described arise, we will endeavor to resolve them as quickly as possible as we want to provide the best service to our customers.

 

  1. Conformity

The item of clothing displayed is a visualization. The final product may differ slightly in construction and color. Color reproduction differs from screen to screen and therefore the images do not represent an exact color reference, but are only intended to provide guidance.

 

  1. Warranty

The warranty is in accordance with the statutory provisions. For all defects that occur during the statutory warranty period of two years from delivery, you have the right to subsequent performance (at your discretion: elimination of the defect or new delivery) and - if the legal requirements are met - the right to a reduction in price or withdrawal as well as to compensation for damages. If the dimensions or design of the bespoke product does not correspond to the dimensions specified for reasons other than those listed above, we will offer you a new, equivalent bespoke product or you will receive a refund. Zauber Lingerie charges the costs of returns in the form of credit to your customer account if the items are sent in the original packaging using the cheapest possible shipping method. As our customer, you are responsible for the dimensions provided.

 

  1. Vouchers

7.1 Promotional vouchers are only valid during the specified promotional period, are not transferable, cannot be combined and cannot be paid out in cash. Individual products can be excluded from voucher promotions. A promotional voucher will not be refunded if the ordered goods are returned in whole or in part.

7.2 Gift vouchers cannot be used to purchase additional gift vouchers and cannot be paid out in cash. A gift voucher is transferable; our general terms and conditions and data protection regulations apply to redeeming the voucher.

7.3 The order value must be at least equal to the amount of the voucher. Any remaining balance cannot be refunded.

7.4 Only one promotional voucher or gift voucher can be redeemed during an ordering process.

7.5 In the event of fraud, attempted deception or suspicion of other illegal activities in connection with the purchase or redemption of a voucher, there is no right to activation, crediting or payment of the voucher.

 

  1. Service

In order to avoid unnecessary costs and to continue to offer attractive prices for our customers, we do not provide telephone customer service. All inquiries will be processed by email and attempted to be answered within 24 hours on working days.   1. Data protection, change of address and copyright

9.1 The customer gives his consent that the personal data contained in the purchase contract will also be automatically stored and processed by us in fulfillment of this contract. Zauber Lingerie is responsible for the personal information provided to us by our customers. These are only used to manage customer relationships. Neither personal information nor email addresses will be passed on to third parties.

9.2 The customer is obliged to inform us of any changes to his or her place of residence. The business address must be disclosed as long as the contractual transaction has not been completely fulfilled by both parties. If notification is omitted, declarations are deemed to have been received even if they are sent to the last announced address.

9.3 The entire content of the website including texts, graphics, photos, images, moving images, sounds, illustrations, software, plans, sketches or other technical documents, as well as samples, catalogs, brochures, illustrations and the like, are our intellectual property. This content is protected by copyright and other rights. Their use is only permitted with our express consent. Unless otherwise stated, all trademarks used on the website are our trademarks. These may not be used without our prior written permission.

 

  1. Applicable law Place of jurisdiction, severability clause

10.1 The law of the Federal Republic of Germany applies exclusively to all legal relationships or other legal relationships with us. The application of the UN Convention on Contracts for the International Sale of Goods is excluded.

10.2 Place of performance and place of jurisdiction is - to the extent legally permissible - Hamburg. However, Zauber Lingerie is also entitled to take legal action at the customer's registered office.

10.3 Should one of these conditions be or become wholly or partially ineffective, this will not affect the effectiveness of the other provisions and the contracting parties undertake to replace the invalid provision with a regulation that comes as close as possible to the original intention of the contracting parties.

10.4 To resolve disputes between you and Zauber Lingerie out of court, you as a customer generally have the option of contacting the European Union's online arbitration board using the following link: http://ec.europa.eu/consumers/odr/

 

  1. Force Majeure

In the event of force majeure, the agreement may either be considered legally canceled, without any compensation obligations for Zauber Lingerie or the customer, or the delivery times will be extended according to the nature of the force majeure. Zauber Lingerie considers as force majeure: war, mobilization, acts of terror, work stoppages, transport disruptions, restrictive measures in trade policy, strikes, non-delivery or overdue deliveries from Zauber Lingerie's suppliers, natural disasters and in general all circumstances, events, reasons and consequences beyond our control.
